Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck when not wearing a seat belt. a) On or about July 20, 2011, and at times prior thereto, an older model powered industrial vehicle, used for handling sheathing for construction of residence, was used without a seat belt. Note: Abatement certification is required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. (a) On or about July 20, 2011, and at times prior thereto, employees framing a residence, were not protected from falls ranging from approximately 10-21 feet on the front of the structure (garage). (b) On or about July 20, 2011, and at times prior thereto, employees framing a residence, were not protected from falls ranging from approximately 10 feet on the back side of the house behind the garage. Note: Abatement certification and documentation are required.
