29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)  Abeyta Home and Plans Inc at 1023 and 1025 Locust Street, Denver, CO 80224:  On July 25, 2011, the controlling employer, the general contractor, did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment made by a competent person.  One employee was observed walking by uncovered window wells.  The window wells were 5 feet deep.  The walking surface near the window wells was cluttered with items such as, but not limited to, wooden planking, cords, and garbage.  This condition exposed employees to fall and tripping hazards.  Abatement Note:  Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).
