29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems: (a) Fred Harris, 1478 Schuyler Road, Toledo, Ohio: On or about July 27, 2011, at the worksite located at 4226 Bonniebrook, Ottawa Hills, Ohio, the employer did not ensure that employees who were performing roofing work approximately 11.5 feet above compacted soil were protected by a guardrail system, safety net system or used an appropriate fall arrest system. The employees were removing roofing material from a two-story residential structure.

29 CFR 1926.503(a)(1): The employers training program did not enable each employee to recognize the hazards of falling and did not train each employee in the procedures to be followed in order to minimize these hazards: (a) Fred Harris, 1478 Schuyler Road, Toledo, Ohio: On or about July 27, 2011, at the worksite located at 4226 Bonniebrook, Ottawa Hills, Ohio, the employer did not ensure that employees were trained in the hazards of working in elevated areas and in the proper use of fall protection systems while performing roofing work. Employees did not recognize the fall hazards, were not knowledgeable in fall protection systems, and were exposed to a fall of approximately 11.5 feet to soil.
