29 CFR 1926.451(a)(1):     Except as provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section, each scaffold and scaffold component shall be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it.    From June 27, 2011 to July 8, 2011 during the installation of air conditioning return/exhaust vents from a roof top, the employer did not ensure that a scissor lift that was used as a catch platform was able to support without failure the intended load that could have been applied to it.

29 CFR 1926.501(b)(1):     "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    From June 27, 2011 to July 8, 2011 during the installation of air conditioning return/exhaust vents from a roof top, the employer did not ensure employees were protected from falls of approximately 35.8 feet by using fall protection systems/devices.

From June 27, 2011 to July 8, 2011 during the installation of air conditioning return/exhaust vents from a roof top, the employer did not ensure employees were protected from falls of approximately 6.2 feet by using fall protection systems/devices.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed inorder to minimize these hazards.      A.              From June 27, 2011 to July 8, 2011, the employer did not ensure employees were trained to recognize 	 the correct fall protection methods for working above and around roof openings; thus exposing  employees                     to a falll of approximately 6.2 feet.       B.              From June 27, 2011 to July 8, 2011, the employer did not ensure employees were trained to recognize 	 the correct fall protection methods for working on a roof and not performing roofing activities; thus                    exposing employees to a fall of approximately 35.8 feet.

29 CFR 1926.502(i)(4):     All covers shall be color coded or they shall be marked with the word "HOLE" or "COVER" to provide warning of the hazard.  Note: This provision does not apply to cast iron manhole covers or steel grates used on streets or roadways.    From June 27, 2011 to July 8, 2011 during the installation of air conditioning return/exhaust vents from a roof top, the employer did not ensure that when a temporary cover was placed over the return/exhaust vents that it was marked with a warning that said hole or cover.

29 CFR 1926.1053(b)(5)(i):     Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).    From June 27, 2001 to July 8, 2011 during the installation of air conditioning return/exhaust vents from a roof top, the employer did not ensure that a portable ladder that was used to access a roof was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).
