29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  (a) Clinimark, LLC at 80 Health Park Dr., suite 20 in Louisville, CO: On or before 7/28/11, the employer did not assess the workplace to determine if hazards were present, or likely to be present, which necessitate the use of PPE.  The employer did not determine if respiratory, hand, eye, and/or face protection were required when making artificial mucous.    Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following:  (1) Identifies the workplace evaluated;  (2) The person certifying that the evaluation has been performed;  (3) The date(s) that the hazard assessment was performed; and  (4) Which identifies the document as a certification of hazard assessment. 29 CFR 1910.133(a)(1): Protective eye and face equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:          (a) Clinimark, LLC at 80 Health Park Dr., suite 20 in Louisville, CO: On or before 7/28/11, the employer did not ensure employees wore safety glasses or chemical goggles while mixing PolyOx and Methocel. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:    (a) Clinimark, LLC at 80 Health Park Dr., suite 20 in Louisville, CO: On or before 7/28/11, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program.  Employees use and are exposed to PolyOx and Methocel.     Abatement note:  The written hazard communication program will also include:  (1)  A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,  (2)  The methods the employer will use to inform employees of the hazards of non-routine tasks. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and -2 on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    (a) Clinimark, LLC at 80 Health Park Dr., suite 20 in Louisville, CO: On or before 7/28/11, the employer did not provide effective information and training to employees regarding the health and safety hazards of the hazardous chemicals in their work area.  Employees use and are exposed to PolyOx and Methocel.    Abatement note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical specific information must always be available through labels and material safety data sheets.
