29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by successful completion of training and evaluation specified in this paragraph:\r\n\r\nOn or about July 26th, 2011, employees were operating forklifts. Prior to allowing employees to use the equipment, the employer did not ensure that each operator had completed training that included all of the truck and workplace related topics listed in the standard and completed an evaluation of the operators\\u0019 performance through practical exercises.

29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition: On or about July 26th, 2011, an employee was using a York/Eaton brand forklift which had faulty brakes and missing side protective panels. The forklift was in need of repair and the employer did not remove it from service.
