An employee was exposed to carbon monoxide and crystalline silica while using a gasoline powered concrete saw in an enclosed area.

29 CFR 1926.55(a):     Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists:     a)  The Law Company Inc., 2400 Elida Rd. , Lima, Ohio:  On or about July 26, 2011, an employee, operating a gasoline powered concrete saw in the dispensary of the salon, was overexposed to carbon monoxide at a concentration of  65.1 parts per million(ppm) as an 8 hour time-weighted average which exceeded the occupational exposure limit of 50 ppm by 130 %.

The employee was overexposed to carbon monoxide at a concentration of  65.1 parts per million(ppm) as an 8 hour time-weighted average which exceeded the occupational exposure limit of 50 ppm by 130 %.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)    a)  The Law Company Inc., 2400 Elida Rd. , Lima, Ohio:  On or about July 26, 2011, the employer did not ensure that an employee using a gasoline powered saw to cut concrete in an enclosed area was provided with information and training about the hazardous materials produced during that operation.   The employee was not trained on the physical and health effects of carbon monoxide and crystalline silica released during the cutting  operations.

29 CFR 1904.29(b)(1):     A log of all recordable work-related injuries and illnesses (OSHA 300 or equivalent), was not completed in the detail as required by the regulation:    The Law Company Inc., 2400 Elida Rd., Lima, Ohio:  On or about May 5, 2011,  the employer did not complete an OSHA 300 in the detail required by the regulation.    a)  The injury and illness records provided by the employer were reviewed, and indicated that on or about June 30, 2011, a recordable injury occurred when an employee slipped and hit their right foot.  The employee's work activity was restricted for 32 days. The employer did not ensure that a description of the injury was recorded in column F of OSHA log.    b)  The injury and illness records provided by the employer were reviewed, and indicated that on or about July 27, 2011, a recordable injury occurred when an employee was cutting duct tape and sheetrock and the knife slipped.  The employer did not ensure that a description of the injury was recorded in column F of OSHA log.

The employee lost 14 days of work and was restricted for 166 days. The employer did not ensure that a description of the injury to the employee was recorded in column F of OSHA log.    b)  The injury and illness records provided by the employer were reviewed, and indicated that on or about October 6, 2009, a recordable injury occurred when an employee hit his knee on an edge form.  The employee had restricted work activity for 15 days.  The employer did not ensure that a description of the injury to the employee was recorded in column F of OSHA log.
