29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) Ambrose Exteriors Inc. at 553 Clarkson St in Denver, CO 80218: On and before July 29, 2011, the controlling employer did not ensure that subcontractor employees were protected from injury, in that four subcontractor employees removing shingles from the second level roof on a two-story residential home were not utilizing a fall protection system. The pitch of the roof on the second level top section was approximately a 5-in-12. The subcontractor employees worked near the edge of the roof to discard the shingles. This condition exposed subcontractor employees to a fall hazard of approximately 21 feet to the ground below.

29 CFR 1926.503(a)(2): The employer did not assure that each employee had been trained by a competent person qualified in the standards contained in subpart M: (a) Ambrose Exteriors Inc. at 553 Clarkson St in Denver, CO 80218: On and before July 29, 2011, the controlling employer did not ensure that each employee who is exposed to fall hazards had been trained by a competent person, in that in that four subcontractor employees removing shingles from the second level roof on a two-story residential home were not utilizing a fall protection system.
