OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fire hazards: a) On or about July 29, 2011, and at times prior, the employer failed to remove a mobile bulk oxygen tank system from service following the discovery of a defective pressure building valve. This tank was involved in a flash fire incident three days after being returned to service. b) On or about July 29, 2011, and at times prior, the employer did not train its employees involved with the delivery of liquid oxygen on the hazards associated with filling oxygen cylinders and working in an oxygen enriched environment.
