On or about September 20, 2011, at the above addressed jobsite, an employee required to conduct drilling operations with a tight-fitting respirator was allowed to have facial hair.  The employee was thereby exposed to the hazards associated with silica exposure.

29 CFR 1926.55(b): To achieve compliance with paragraph (a) of this section, administrative or engineering controls must first be implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and technical measures used for this purpose must first be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1926.103.    a. On or about July 29, 2011, at the above addressed jobsite, an employee was exposed to respirable silica while operating the EZ Drill Rig.  The employee was exposed to respirable dust containing 4.5% crystalline silica (quartz) at an 8-hour time-weighted average level of 45.4 millions of particles per cubic foot (mppcf), approximately 1.7 times the calculated permissible exposure limit (PEL) of 26.8 mppcf.  The limit was established to prevent silicosis.    b.On or about September 20, 2011, at the above addressed jobsite, an employee was exposed to respirable silica while operating the EZ Drill Rig.  The employee was exposed to respirable dust containing 3.8% crystalline silica (quartz) at an 8-hour time-weighted average level of 68.6 millions of particles per cubic foot (mppcf), approximately 2.4 times the calculated permissible exposure limit (PEL) of 28.9 mppcf.  The limit was established to prevent silicosis.    1.  General engineering methods of control applicable in these circumstances include, but are not limited to, the following:              a. E-Z Drill pneumatically powered vacuum systems that can mount on the drill unit.    b. Use a water application during the drilling operation.    2.  Administrative controls applicable in these circumstances include, but are not limited to, the following:    a.  Rotation of employees during drilling operations to reduce employee exposure to below the PEL.

29 CFR 1926.52(d)(1): In all cases where the sound levels exceed the values shown herein, a continuing, effective hearing conservation program shall be administered.         a.  An employee was helping with drilling concrete with an e-z Drill during road replacement operations.  The employee was exposed to continuous noise levels at 421% of the allowable 8-hour time weighted average sound level (90dBA).  The equivalent dBa level of 421% is approximately 100.4 dBA.  The sampling was performed for 401 minutes during one shift on July 29, 2011.  Zero exposure was assumed for the unsampled period of time of 79 minutes.    b.  An employee was drilling concrete with an e-z Drill during road replacement operations.  The employee was exposed to continuous noise levels at 659% of the allowable 8-hour time weighted average sound level (90dBA).  The equivalent dBa level of 659% is approximately 103.6 dBA.  The sampling was performed for 404 minutes during one shift on July 29, 2011.  Zero exposure was assumed for the unsampled period of time of 76 minutes.      An effective hearing conservation program which included monitoring of employee noise exposure, baseline and annual audiometric testing of employees and record keeping was not instituted by American concrete Restorations, Inc, when employee exposure to noise exceeded TABLE D-2 - PERMISSIBLE NOISE EXPOSURES.
