29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:\r\n(a)  Rocky Mountain Excavating and Concrete at 8th Street and Walnut Street, Auraria Campus, Denver, CO 80204:  On July 28, 2011, the controlling/exposing employer did not instruct each employee in the recognition and avoidance of unsafe conditions in that employees working in and near a trench for the installation of electrical conduit had not received any training on excavations or trenches.  The trench was approximately 6 feet wide and ranged from approximately 5 feet to 10 feet in depth.  This condition exposed employees to a cave-in hazard.\r\nAbatement Note:  Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:\\r\\n(a)  Rocky Mountain Excavating and Concrete at 8th Street and Walnut Street, Auraria Campus, Denver, CO 80204:  On July 28, 2011, the controlling/exposing employer did not have a competent person conduct an inspection of the excavation.  An excavation was dug for installation of electrical conduit that was approximately 6 feet wide, 100 feet in length, and ranged from 5 feet to 10 feet in depth.  The excavation had vertical walls.  Soil type was determined to be Type B.  Employees accessed the trench via a ladder placed outside of the trench box.  Employees also used materials for conduit installation that were placed outside the trench box.  These conditions exposed employees to a cave-in hazard.\\r\\nAbatement Note:  Abatement certification is required for this item (see enclosed \\u001CSample Abatement Certification Letter\\u001D).

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):\\r\\n(a)  Rocky Mountain Excavating and Concrete at 8th Street and Walnut Street, Auraria Campus, Denver, CO 80204:  On July 28, 2011, the controlling/exposing employer did not protect each employee from a cave-in by using an adequate protective system while conducting trenching operations to install electrical conduit.  The trench box was placed on the short side which measured 3.9 feet in length.  Employees accessed the trench via a ladder that was placed outside the trench box.  The excavation lacked an adequate protective system in that the trench box was not long enough to allow for a ladder to be placed inside the trench box.  This condition exposed employees to a cave-in hazard.\\r\\n(b)  Rocky Mountain Excavating and Concrete at 8th Street and Walnut Street, Auraria Campus, Denver, CO 80204:  On July 28, 2011, the controlling/exposing employer did not protect each employee from a cave-in by using an adequate protective system while conducting trenching operations to install electrical conduit.  Employees worked outside the trench boxes onsite to install electrical conduit racking and to shovel dirt.  Furthermore, materials were being stacked and stored next to the trench box and were used to complete operations.  This condition exposed employees to a cave-in hazard.\\r\\nAbatement Note:  Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).
