29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:       a) Jobsite: On July 27, 2011 and times prior thereto, employees were exposed to fall hazards ranging from approximately nine to 18 feet while performing sheathing activities on a six in twelve pitched roof with out a fall protection system in place.       Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:     a) Jobsite: On July 27, 2011 and times prior thereto, employees and the responsible person on site, did not acknowledge the fall hazards when performing framing activities that included sheathing, and take the appropriate actions to eliminate or minimize these hazards.    Note: Effective September 16, 2011 conventional methods for fall protection, per 29 CFR 1926.501(b)(13) shall be used.  The alternative methods for fall protection in residential construction as described in STD 03-00-001 will no longer be acceptable.      Note: Abatement certification IS required for this item.

29 CFR 1926.1052(c)(1)(ii): Stairways having more than four risers or rising more than 30 inches was not equipped with one stairrail system along each unprotected side or edge:     a) Jobsite: On July 27, 2011 and times prior, the interior stairway used for access to and from the second level did not have a stairrail system in place.  Stairway had approximately 16 risers.    Note) Abatement certification IS NOT required for this item.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder:    a) Jobsite: On July 27, 2011 employee(s) were exposed to an approximate nine foot fall hazard when using an extension ladder for access to and from the roof level, which was positioned such that the top rung of the ladder was even with the eave line of the roof.
