29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Tom Magrum, Findlay, Ohio:  On or about July 29, 2011, at address 3011 Heatherdowns Dr., Findlay, OH, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying objects.    b) Tom Magrum, Findlay, Ohio:  On or about July 29, 2011, at address 3011 Heatherdowns Dr., Findlay, OH, the employer failed to ensure that each employee was provided appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying objects.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:    a) Tom Magrum, Malinta, Ohio:  On or about July 29, 2011, at the address 3011 Heatherdowns Dr., Findlay, OH, the employer did not ensure that a means of access was provided for employees using a ladder jack scaffold approximately 18.3 feet above the level below, exposing employees to falls.  The exposed employees climbed the supporting ladders to access the ladder jack and roof.  More than two feet separated the access ladder rung and the working platform.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) Tom Magrum, Malinta, Ohio:  On or about July 29, 2011, at the address 3011 Heatherdowns Dr., Findlay, OH, the employer did not ensure that employees were protected from falls while working from a ladder jack scaffold.  Employees were exposed to falls of approximately 18.3 feet to the level below during roofing operations of a residential structure.  No form of fall protection was in place.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Tom Magrum, Malinta, Ohio:  On or about July 29, 2011, at address 3011 Heatherdowns Dr., Findlay, OH, the employer did not ensure that employees were protected from falls while applying new roofing to a sloped 8:12 pitch roof on a 2-story residential type structure.  Employees were exposed to a potential 18.3 ft. fall to the lower level below.
