Section (5) (a) (1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling when ascending and descending portable metal ladders to gain access to the roof top of the dairy refrigerator unit, which was used as a overhead storage mezzanine:    (a)     Buxman Enterprises, LTD., @ 34295 Highway 6, Edwards, CO.  On or before July 16, 2011, the employer did not ensure that an appropriate portable ladder that will extend at least 3 feet above the dairy cooler roof top was provided to enable safe egress and access to the overhead storage mezzanine. This condition exposed employees to the hazard of falling from elevation at an approximate height of 92 to the ground.         Additional portable ladders safety requirements were not met as follows:    1)	The employer did not ensure that because of the ladder length and type, the top of top step of the stepladder was being used by employees to gain access to the roof top of the dairy refrigerator unit.  This condition exposed the employees to the hazard of loosing balance and/or tipping the ladder over sideways or causing the stepladder base to slide.  Portable ladders are not designed for excessive side loading. It should be avoided. This condition exposed employees to the hazard of falling from elevation at an approximate height of 92 to the ground.       2)	The employer did not ensure that each employee who used portable metal ladders was provided adequate ladder safety training as required under the standard. This condition exposed the employees to the hazard of falling when ascending and descending portable metal ladders to gain access to the roof top of the dairy refrigerator unit, which was used as an overhead storage mezzanine.      5 (a) (1) ELEMENTS:      1. The employer failed to keep the workplace free of hazards to which employees of the employer were exposed to the hazard of falling when ascending and descending portable metal ladders to gain access to the roof top of the dairy refrigerator unit, which was used as an overhead storage mezzanine:    2. The hazard is a recognized hazard under the ANSI-A14-2-2000 to reduce exposing employees to the hazard of falling when ascending and descending portable metal ladders to gain access to the roof top of the dairy refrigerator unit, which was used as an overhead storage mezzanine:    3. The hazard is causing or likely to cause serious physical harm the employer did not ensure that an appropriate portable ladder that will extend at least 3 feet above the dairy cooler roof top was provided to enable safe egress and access to the overhead storage mezzanine. This condition exposed employees to the hazard of falling from elevation at an approximate height of 92 to the ground.       4. Among other methods, one feasible and acceptable abatement methods to correct the hazard is to ensure that when portable ladders are used to gain access to upper access levels, they shall be extended at least 3 feet above the roof top line to enable safe access and egress.

29 CFR 1910.23(c)(1)      29 CFR 1910.23(c)(1):  Open sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 1910.23(e)(3)(i) through (v)), on all open sides:    (a)	Buxman Enterprises, LTD., @ 34295 Highway 6, Edwards, CO.  On or before July 16, 2011, the employer did not ensure that standard guardrails systems or any other suitable fall protection systems was provided on the open-sided roof of the dairy refrigerator unit used as a overhead storage mezzanine.  This condition exposed employees to the hazard of falling from elevation at an approximate height of 92 to the ground.   On July 1, 2011, an employee while looking for supplies stored on top of the dairy refrigerator unit, fell through one of the suspended ceiling panels landing on the floor of aisle # 8.       Abatement Note:  The following is provided to assist in the abatement of this hazard:    (1)	A standard railing shall consist of top rail, intermediate rail, and posts, and shall have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The top rail shall be smooth-surfaced throughout the length of the railing. The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp. The ends of the rails shall not overhang the terminal posts except where such overhang does not constitute a projection hazard.    (2)	A standard toeboard shall be 4 inches nominal in vertical height from its top edge to the level of the floor, platform, runway, or ramp. It shall be securely fastened in place and with not more than 1/4-inch clearance above floor level. It may be made of any substantial material either solid or with openings not over 1 inch in greatest dimension.

29 CFR 1910.212(a)(1):  Machine guarding was not adequately provided to protect operator(s) and other employees from hazard(s) created by moving and rotating parts during operating cycles:    (a) Buxman Enterprises, LTD., @ 34295 Highway 6, Edwards, CO.  On or before July 16, 2011, the employer did not ensure that guard made out of expandable metal attached on the interlocking door for the cardboard compactor was adequately and securely fasten in place to prevent detachment during the operating cycles.  This condition exposed employees to the hazards such as those created by moving parts in an event of accidental contact.

29 CFR 1910.303(g)(1)(i): Sufficient access and working space was not provided and maintained on all electric equipment to permit ready and safe operation and maintenance of such electrical equipment rated @ 600 volts or less, as specified in Table S-1:     Buxman Enterprises, LTD., @ 34295 Highway 6, Edwards, CO.  On or before July 16, 2011, the employer did not ensure that the working space in front of the electrical panels on the east wall in facing the dairy cooler was maintained at a minimum clear working space of 3 feet.  Boxes and other items were being stored along the wall on the floor reducing the space and presenting a potential electrical hazard to the employees needing access to the panels.

On or before July 16, 2011, the employer did not ensure an extension orange cord plugged into a receptacle at the roof of the cooler adjacent to the employees break bench was used as a substitute for the fixed wiring of a structure for purpose to powering appliances  such but not limited to lights, clock and a microwawe oven, and other equipment. This condition exposed the employees to an electrical hazard.
