29 CFR 1910.266(d)(1)(iv): The employer shall provide, at no cost to the employee, and assure that each employee who operates a chain saw wears leg protection constructed with cut-resistant material, such as ballistic nylon. The leg protection shall cover the full length of the thigh to the top of the boot on each leg to protect against contact with a moving chain saw. Exception: This requirement does not apply when an employee is working as a climber if the employer demonstrates that a greater hazard is posed by wearing leg protection in the particular situation, or when an employee is working from a vehicular mounted elevating and rotating work platform meeting the requirements of 29 CFR 1910.68:\\r\\n\\r\\na. Campbell Road Sawmill worksite located in Archbold, Ohio:  On or about August 3, 2011, the employer did not ensure employees using chainsaws to fell trees were wearing leg protection constructed of cut resistant material.  \\r\\n\\r\\nIn accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Campbell Road Sawmill work location in Archbold, Ohio:  On or about August 3, 2011, the employer did not ensure employees felled trees in a manner that did not create hazards for employees.  An employee felled a large, side heavy tree, but as the tree fell in an unintended direction it struck another previously cut tree which had been left standing.  The second tree fell and fatally injured the employee while narrowly missing a second employee.\\\\r\\\\n\\\\r\\\\nIn accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.266(h)(2)(i):  Before felling is started, the feller shall plan and clear a retreat path. The retreat path shall extend diagonally away from the expected felling line unless the employer demonstrates that such a retreat path poses a greater hazard than an alternate path. Once the backcut has been made the feller shall immediately move a safe distance away from the tree on the retreat path.    a. Campbell Road Sawmill work location in Archbold, Ohio:  On or about August 4, 2011, the employer did not ensure employees planned and cleared a retreat path.  The retreat path to the south of the felling operation was blocked by the trunk of a previously felled tree, brush, and other smaller trees.    b. Campbell Road Sawmill work location in Archbold, Ohio:  On or about August 3, 2011, the employer did not ensure employees performing felling operations immediately moved a safe distance away from the tree on the retreat path.  A second employee whose saw had become lodged in the tree continued to grasp his saw handle, tried to free his saw from the tree as the tree was falling, and did not use the retreat path to the north of the felling operation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
