Walnut, St. Marys, OH, the employer failed to ensure that each employee was provided appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

Walnut, St. Marys, OH, the employer failed to ensure that the scaffolding level from which an employee was installing roofing materials was fully planked.  Several planks were missing from the tubular welded frame scaffold, exposing employees to a fall of approximately 15.6 feet to the ground below.

29 CFR 1926.451(e)(1):  When scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral pre-fabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a) Legion Construction, St. Marys, Ohio:  On or about July 28, 2011, at address 220 N. Walnut, Saint. Marys, OH, the employer failed to ensure that a ladder or similar safe means of access was provided to employees using a welded frame scaffold.  Employees were exposed to an approximate fall of 15.6 ft. fall to the ground below when climbing the horizontal members of the outward upward supports.  The scaffolding unit did have integral prefab access, but the frames were not installed to allow for continuous or aligned access to the working platform.

Walnut St., St. Marys, Ohio the employer failed to ensure that the top of a 6 ft. A-framed stepladder was not used as a step by employees.  The employees were using the top of the ladder to access the roof of a residential structure.  The employees utilizing the ladder in this condition were exposed to fall hazards of approximately 8 feet.
