29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral pre-fabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used: a) Legion Construction, St. Marys, Ohio: On or about July 28, 2011, at address 220 N. Walnut, Saint. Marys, OH, the employer failed to ensure that a ladder or similar safe means of access was provided to employees using a welded frame scaffold. Employees were exposed to an approximate fall of 15.6 ft. fall to the ground below when climbing the horizontal members of the outward upward supports. The scaffolding unit did have integral prefab access, but the frames were not installed to allow for continuous or aligned access to the working platform.
