29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable aspart of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under1926.502(e). On or about 08/08/11 during bridge building activities, the employer did not ensure an employee used fall protection devices/systems while using an aerial lift; thus exposing the employee to a fall of approximately 21.6 feet. \r\n\r\n TERRACE CONSTRUCTION COMPANY INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD CFR 1926.453(B)(2)(V), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313845737, CITATION NUMBER 01, ITEM NUMBER 01 AND WAS AFFIRMED AS A FINAL ORDER ON 09/30/09, WITH RESPECT TO A WORKPLACE LOCATED AT STATE ROUTE 306 KIRTLAND, OHIO 44094.

" Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 08/08/11 during bridge building activities, the employer did not ensure an employee used fall protection devices/systems when working on an open sided bridge deck; thus exposing the employee to a fall of approximately 21.6 feet.
