29 CFR 1910.134(g)(1)(i)(A):The employer did not prohibit the use of respirators with tight-fitting facepieces to be worn by employees who had facial hair that came between the sealing surface of the facepiece and the face. a. Marble Emporium Inc. - The employer did not ensure that an employee using a tight fitting facepiece respirator did not have facial hair hat comes between the sealing surface of the faces and the face or that interferes with valve functions. The employee was required to use a 3M 8120 dual strap respirators during marble and granite fabricating operations and facial hair, ie mustch and beard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with you certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.4(a): A record (OSHA 300 or equivalent) of all work-related fatalities, injuries and illnesses was not maintained. a) Marble Emporium Inc. The employer did not maintained at the workplace a record of all work-related fatalities, injuries and illnesses. The OSHA 300 log for 2010 was not properly filled out to identify and reflect the extent of the injuries and illnesses that occured at the facility. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
