29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a) Elbert Building Co., Inc. on or about August 16, 2011, at the site located near the intersection of Middle Ave. and 4th St. Elyria, OH: The employer failed to ensure a safe means of egress such as a ladder was provided to employees installing water line in a 5 ft deep trench.

29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not provided with and/or wearing, warning vests or other suitable garments marked with or made of reflectorized or high-visibility material. a) Elbert Building Co., Inc. on or about August 16, 2011, at the site located near the intersection of Middle Ave. and 4th St. Elyria, OH: The employer failed to ensure all employees wore high visibility garments while working near an active roadway at an excavation. Due to this condition, employees walking in and working parallel to the roadway were exposed to potential struck-by injuries caused from a vehicular collision.
