29 CFR 1926.501(b)(1) Each employee on a walking/working surface with an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Beartrax, LLC, 16199 Green Valley Ranch Blvd, Denver, CO: The controlling employer had not ensured the use of appropriate fall protection while employees of a sub contractror worked on roofs. On or about August 11, 2011, employees of a sub contractor were observed painting trim on various building roofs without fall protection. Condition exposed employees to fall hazards up to approximately 15 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a)Beartrax, LLC, 16199 Green Valley Ranch Blvd., Denver, CO: The controlling employer in charge of the worksite had not ensured a competent person conducted frequent inspections to identify and correct hazards associated with falls while working on roofs. On or about August 11, 2011 the sub-contractors employees were painting various buildings while standing on the roofs without using an appropriate fall protection system. Condition exposed the sub-contractors employees to a fall hazard of approximately 15 feet. OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).
