29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On or about August 18, 2011, at the facility, employees required to access and work atop of tankers/trailers/railcars during chemical loading and off-loading operations were exposed to fall hazards from a height of approximately 10 to 12 feet above ground. Protective equipment, such as a body harness and lanyard, was not used to protect against injury and impairment in the event of a fall. Loading and off-loading operations were conducted contiguous to loading racks/platforms where the installation of fall protection was feasible.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: On or about August 18, 2011, at the facility, employees required to perform acid and caustic tanker/trailer/railcar loading and off-loading operations were exposed to the hazard of skin contact with injurious corrosive chemicals including Sulfuric Acid (93%) and Sodium Hydroxide (50%). The employer did not ensure that each affected employee used appropriate face protection (face shield) to protect against injury.
