29 CFR 1910.67(c)(2)(v):  A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:    a) Saylor Tree Service & Stump Removal, LLC, Napoleon, Ohio:  On or about August 17, 2011, at address 1032 Scott St., Napoleon, Ohio, the employer did not ensure that each employee performing tree service from an elevated vehicle mounted platform wore a personal fall arrest system.  An employee performing work in this condition was exposed to falls of approximately 15-20 feet while engaged in this activity.

29 CFR 1910.135(a)(1):  The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:    a) Saylor Tree Service & Stump Removal, LLC, Napoleon, Ohio:  On or about August 17, 2011, at address 1032 Scott St., Napoleon, Ohio, the employer did not ensure that each employee used appropriate head protection while working below an employee who was conducting tree trimming operations.  Employees were exposed to potential impact injuries caused by falling branches and/or equipment.
