29 CFR 1926.501(b)(1):     Each employee on a walking/working surface, with an unprotected side or edge which is 6 feet or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a) Schmucker Construction:  On or about August 19, 2011, at the new Holiday Inn construction project, located near Hampton Inn and Suites on 540 East County Rd. 89, Fremont, Ohio, the employer did not ensure that employees were protected from falls while performing framing activities.  Employees were working on a flat portion of the 3rd floor and were not protected from an approximate 20.4 ft. fall hazard at the unprotected edge of the roof.

1926.501(b)(14):  Each employee working on, at, above or near wall openings where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:    a) Schmucker Construction:  On or about August 19, 2011, at the new Holiday Inn construction project, located near Hampton Inn and Suites on 540 East County Rd. 89, Fremont, Ohio, the employer did not ensure that each employee working near wall openings were protected from falls of approximately 20.4 ft. by use of an approved fall protection system.

1926.503(b)(1):  The employer did not verify compliance with paragraph (a) of this section by preparing a certification record containing the name, date, and signature of the employee(s) being trained:    a) Schmucker Construction:  On or about August 19, 2011, at the new Holiday Inn construction project, located near Hampton Inn and Suites on 540 East County Rd. 89, Fremont, Ohio, the employer did not develop or maintain a written record of certification for training on all employees who might be exposed to fall hazards.  It had been evaluated during employee and employer interviews that exposed employees had been trained, though the employer could not produce a written certification of their training.
