29 CFR 1910.95(d)(1): \n\nWhen information indicates that any employee\'s exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program.\n\na. The employer had not developed and implemented a monitoring program for employees working in the block machine area. An employee operating the block machine was exposed to continuous noise at 106.1 dose percent which exceeded the action level (AL) of 50 percent, an eight hour time weighted average (TWA) sound level of 85 dBA. The employee\'s eight hour TWA sound level was approximately 90.4 dBA during the 475 minute sampling period on August 24, 2011. Exposure calculations included a zero increment for the 5 minutes not sampled. \n\nb. The employer had not developed and implemented a monitoring program for employees working in the block machine area. An employee operating the block machine was exposed to continuous noise at 110.7 dose percent which exceeded the action level (AL) of 50 percent, an eight hour time weighted average (TWA) sound level of 85 dBA. The employee\'s eight hour TWA sound level was approximately 90.7 dBA during the 477 minute sampling period on August 24, 2011. Exposure calculations included a zero increment for the 3 minutes not sampled. \n\nc.
