29 CFR 1910.178(g)(2): Facilities shall be provided for flushing and neutralizing spilled electrolyte, for fire protection, for protecting charging apparatus from damage by trucks, and for adequate ventilation for dispersal of fumes from gassing batteries. a) At the Yenkin-Majestic Paint Corporation in Columbus, Ohio, the warehouse had a Hobart Battery Charger (model # 865-c3-18, Serial # 389cs09135) that was sitting on a pallet on the floor, within two to three feet of where the forklifts drive and park on a daily basis, and was not protected from damage from the forklifts.

29 CFR 1910.305(g)(1)(iv)(A): Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used: As a substitute for the fixed wiring of a structure; a) At the Yenkin-Majestic Paint Corporation, the battery charging station in the warehouse had a Hobart battery charger (Model # 865c3-18, Serial # 389cs09135), that was sitting on a pallet on the floor. The manufacturer of the battery charger required it to be securely mounted to concrete floor or a base. The battery charger was powered using approximately 10 foot flexible cord (type SEOOW) instead of fixed wiring in conduit.

29 CFR 1910.24(h): "Railings and handrails." Standard railings shall be provided on the open sides of all exposed stairways and stair platforms. Handrails shall be provided on at least one side of closed stairways preferably on the right side descending. Stair railings and handrails shall be installed in accordance with the provisions of 1910.23. a) At the Yenkin-Magestic Paint Corporation in Columbus, Ohio the entrance stairs to the warehouse facility, that were six risers in height, were not equipped with a mid-rail.
