OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potentially hazardous atmospheres while working in a confined space.    On or about August 19, 2011 employees were working in a confined space, manhole vault, to cap a leaking water valve. The employees were working without a confined space program which should include but not be limited to permit system, ventilation, atmospheric testing, rescue procedures (including equipment: harnesses and life lines), designation of qualified people for standby and emergency procedures, and protective measures to ensure the safety of the workers.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)
