29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used: a. On or about August 15, 2011, at the above addressed jobsite, employees accessing and/or egressing the ladder jack scaffolding were required to crawl over the work platform from the access (support) ladders as opposed to stepping from the ladder directly onto the work platform as the platform was positioned on the backside of the ladders.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold shall be protected by a personal fall arrest system: On or about August 15, 2011, at the above addressed jobsite, employees working from the ladder jack scaffolds were not protected from falls by use of a personal fall arrest system.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems: a. On or about August 15, 2011, at the above addressed jobsite, employees working atop the 9/12 to 10/12 pitched roof levels were exposed to falls which varied from approximately 10'2" to 12'6", depending on which roof level the work was being done on, due to the lack of fall protection. DAVIS ROOFING & CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN INSPECTION NUMBER 314735895, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 13, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 855 LEE STREET IN DES PLAINES, IL
