On or about August 16, 2011, at the above addressed jobsite, employees working from the 19 inch wide aluminum scaffold platform on the masonry frame scaffold were exposed to falls of approximately 12'8" due to the lack of fully decked work levels.

On or about August 16, 2011, at the above addressed jobsite, employees working from the upper platform of the masonry frame scaffold were exposed to falls of approximately 12'8" due to the lack of fall protection (guardrails).

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access: a. On or about August 16, 2011, at the above addressed jobsite, safe access/egress was not provided to: (a) the masonry wallkthrough scaffold which the employees were accessing/egressing by use of the scaffold frame and/or the cross braces and (b) the ladder jack scaffold which was supported on the climbing side of the support ladders which resulted in the employee crawling over the platform from the ladder rather than stepping directly onto the work platform from the ladder.
