29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a) GE Construction, Inc. at W Eisenhower Blvd & Wilson Ave in Loveland, CO 80537: On and before August 17, 2011, the exposing employer did not ensure that each employee connecting utility lines inside an excavation that measured approximately 5 feet 5 inches in depth was protected from cave-in. Employees worked inside the excavation without the use of a protective system. The sides of the excavation had vertical walls, and the slope of the north end of the excavation measured approximately 60 degrees. The condition exposed employees to a crushing hazard by excavation wall cave-in. (b) GE Construction, Inc. at W Eisenhower Blvd & Wilson Ave in Loveland, CO 80537: On and before August 17, 2011, the exposing employer did not ensure that each employee connecting utility lines inside an excavation that measured approximately 5 feet 5 inches in depth was protected from cave-in. The employer used a hydraulic shoring protective system to protect employees; however, the north side of the excavation was unprotected. The slope of the north end of the excavation measured approximately 60 degrees. The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i), in that the maximum allowable slope associated with Type B soil is an angle of 45 degrees, from toe to top. The condition exposed employees to a crushing hazard by excavation wall cave-in. GE Construction, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.652(a)(1) which was contained in OSHA Inspection Number 314661380, Citation 1, Item 1a, issued on December 22, 2010, and became Final Order on February 4, 2011, with respect to a workplace located at W 1st St & Namaqua, Loveland, CO 80537.
