29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:\r\n\r\na)  Ascencio, Juan dba J & D Framing at 570 Cheyenne Drive, Lafayette, CO 80026:  On or before August 20, 2011, the employer did not ensure that employees were using fall protection when framing this two story residence in the following instances:\r\n\r\n     1)  Employees were sheathing the 5 in 12 pitch roof without fall protection, with a fall hazard of 22' measured from the eave to the ground;   2)  The second floor included unguarded window openings measuring 1)  2' high and 2' wide, 2)  2' high and 6' wide;  3)  3' high and 30" wide;  4)  16" high and 4' wide with a fall hazard of 14' to the ground\'\r\n\r\n   3)  The second floor included an unguarded open landing to the main floor measuring 16\' long, with a fall distance of 12';\r\n\r\n    4)  The second floor included an open landing for the stairway hole measuring 40\" on the east and west sides, and 11' on the norths side, with a fall hazard of 19\' to the basement;\r\n\r\n    5)  The main floor included an open landing for the stairway hole measuring 40\" on the east, west, and north sides.  In addition, the south wall facing the garage included studs 2' on center, and was missing horizontal guardrails; and\r\n\r\n    6)  Two basement window wells, measuring 3\' x 5\' and 6\' deep, were not guarded.\r\n\r\nCondition exposed employees to fall hazards of up to 22 feet.\r\n\r\nAbatement note:  Abatement certification is required for this item (See enclosed \"Certification of Corrective Action Worksheet\").\r\n

With the top step of the stepladders 38" below the top of the trusses, and the employees used the top step of the stepladders to access the trusses.
