Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential fire/explosion hazards from leaking fuel nozzles: (a) On or about June 22, 2011, and at times prior to that date, at Executive Air Taxi Corporation, the employer did not ensure that employees were protected from potential fire/explosion hazards during aircraft fueling operations. One instance of this violative practice was on June 22, 2011, when employees were allowed to use Truck #5003 with a leak at the swivel on the single-point nozzle. Among other methods, one feasible and acceptable method to correct this hazard is to develop and implement a written procedure to inspect aircraft fuel trucks before each use as identified in NFPA 407, National Fire Protection Association - Standard for Aircraft Fuel Servicing.
