29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above the lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems nor was another provision in paragraph (b) of this section provided:    a) Robert Harmon's Roofing, Perrysburg, Ohio:  On or about August 22, 2011, at address Lot 106 on Sterlingwood Lane inside of the Brookhaven Subdivision, Perrysburg, Ohio, the employer did not ensure that employees were protected from falls while applying new roofing to a steep sloped roof on a residential type structure.  Employees were exposed to falls of approximately 19.7 feet to the ground below.

29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for the eyes, was not used where ever it was necessary by reason of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact:    a) Robert Harmon's Roofing, Perrysburg, Ohio:  On or about August 22, 2011, at address Lot 106 on Sterlingwood Lane inside of the Brookhaven Subdivision, Perrysburg, Ohio, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nail gun, exposing employees to eye injuries from flying particles.    Robert Harmons Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA Inspection Number 311602585, Citation Number 1, Item Number 2 and was affirmed as a final order on May 14, 2008, with respect to a workplace located at 13319 Roachton Road, Perrysburg, Ohio.
