29 CFR 1910.1200(e)(1):     Employers shall develop, implement, and maintain at each workplace, a written hazard communicationprogram which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    The employer did not develop or implement a written hazard communication program for employees who were exposed to hazardous chemicals used in the servicing of automobiles or maintenance of the business, such as:    a) Gasoline    b) Motor oils    c) Antifreeze    c) Windshield washer solutions     e)Transmission fluid    f) Grease    g) Toilet and other cleaning chemicals    Abatement Certifiaction and Abatement Documentation Required

29 CFR 1910.1200(h)(1):     Employers did notl provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area:    a) Employees exposed to hazardous chemicals in the servicing of automobiles and in the maintenance of the facility were not trained regarding those chemicals or their hazards.  These chemicals included motor oils, gasoline, greases, transmission fluid, windshield washer fluid, antifreeze and toilet and shop cleaning sulutions.    Abatement Certification and Abatement Documentation Required.

29 CFR 1910.1200(f)(5):     Except as provided in paragraphs (f)(6) and (f)(7) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with the identity of the hazardous chemical contained therein:    On 8/23/11, the following containers were not labelled with the identity of the hazardous chemicals contained:    a) The tote of windshield washer solution located in the pit area below the northern bay was mis-labelled as Rohm & Haas Tamel L Conc.    b) The tote of green antifreeze in the pit area was mis-labelled as Polymin PS.    c) The tote of 5W20 oil in the basment was mis-labelled as Hercules Hercon 70 Sizing Emulsion.    d) The two (2) oil tanks in the southwestern pit area were not labelled. 29 CFR 1910.1200(g)(8):     The employer did not maintain in the workplace copies of the required material safety data sheets for each hazardous chemical, and ensure that they were readily accessible during each work shift to employees when they were in their work area(s):    a) Material safety data sheets (MSDS) for 5W-20, 5W-30, 10W-30 or 10W40 motor oils were not available in the workplace.    b) An MSDS for windshield washer fluid was not available in the workplace.    c) A MSDS for Green Antifreeze was not available in the workplace.    d) A MSDS for Mobil Grease XHP 222 Special was not available in the workplace.    e) A Msds for 76 MP Gear Lube SAE 80W-90 was not available in the workplace.    f) A MSDS for The Works Toilet bowl cleaner was not available in the workplace.    g) A MSDS for Global Antifreeze was not available in the workplace.    h) A MSDS for Jungle Jake Cleaner was not available in the workplace.
