29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes was not used where it is necessary by reason of a hazardous process.    (a)	Black Diamond Roofing, 1868 Wenz Road, Wakeman, Ohio:  On or about August 23, 2011, at the work site located at 4904 Route 601, Norwalk, Ohio, the employer did not ensure that an employee installing roofing material on a one story residential structure with a pneumatic nailer wore eye protection.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:           (a)	Black Diamond Roofing, 1868 Wenz Road, Wakeman, Ohio:  On or about August 23, 2011, at the work site located at 4904 Route 601, Norwalk, Ohio, the employer did not ensure that employees who were performing roofing work approximately 11 feet above grass were protected by a guardrail system, safety net system or used an appropriate fall arrest system.  The employees were installing roofing material on a one-story residential structure.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a)	Black Diamond Roofing, 1868 Wenz Road, Wakeman, Ohio:  On or about August 23, 2011, at the work site located at 4904 Route 601, Norwalk, Ohio, the employer did not ensure that employees received comprehensive training on the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while working on a roof. Employees did not use fall protection and were exposed to approximately 11 feet fall hazard from the roof to the ground.
