29 CFR 1926.403(b)(1): Examination. The employer shall ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:    a)  On or about August 26, 2011 and at times prior, Klinke & Lew Contractors did not examine/inspect the electrical circuits and equipment at the jobsite.  Employees were not protected from electrical hazards.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous:    a)  On or about August 26, 2011 and at times prior, Klinke & Lew Construction did not ensure that employees were protected from electrical hazards.  Employees did use electrical tools and cords which were missing the grounding prong on their plug end.

29 CFR 1926.405(g)(2)(iii): Splices. Flexible cords shall be used only in continuous lengths without splice or tap. Hardservice flexible cords No. 12 or larger may be repaired if spliced so that the splice retains the insulation, outer sheath properties, and usage characteristics of the cord being spliced.    a)  On or about August 26, 2011 and at times prior, Klinke & Lew Contractors did not ensure that employees were protected from electrical hazards.  The crew did use cords which had been improperly spliced.  The conductors were improperly connected and the outer insulation had been replaced with electrical tape.  These processes do not return the cords to the manufacturers specifications.

Flexible cords shall be connected to devices and fittings so that strain reliefis provided which will prevent pull from being directly transmitted to joints or terminal screws.    a)  On or about August 26, 2011 and at times prior, Klinke & Lew Contractors did not ensure that employees were protected from electrical hazards.  The crew did use cords and tools with strain relief problems.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section,each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall beprotected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safetymonitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring systemalone [i.e. without the warning line system] is permitted.    a)  On or about August 26, 2011 and at times prior, Klinke & Lew Contractors did not ensure that employees were protected from fall hazards.  Employees installing new roofing materials on a low slope roof were not protected from falls.  The employees were not using any type of fall protection system.
