29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:\\r\\n\\r\\na)  Cisneros, Jose dba Cisneros Construction at 3373 Ulster Street, Denver, CO 80238:  On or before August 27, 2011, the employer did not ensure that employees wore safety glasses when using or working in the vicinity of pneumatic nail guns.  Condition exposed employees to the hazard of projectiles to the eyes.\\r\\n\\r\\nAbatement note:  Abatement certification is required for this item (see enclosed, \\\"Certification of Corrective Action Worksheet\\\").\\r\\n

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:\\r\\n\\r\\na)  Cisneros, Jose dba Cisneros Construction at 3373 Ulster Street, Denver, CO 80238:  On or before August 27, 2011, the employer did not ensure that employees were using fall protection when framing this two story residence in the following instances:\\r\\n\\r\\n1)  An employee was walking the top plate without the use of fall protection.  Condition exposed employee to fall hazards of 22\\\';\\r\\n\\r\\n2)  Employees were working near the unguarded stairway hole on the second floor.  Condition exposed employees to fall hazards of 20\\\';\\r\\n\\r\\n3)  Employees were working near the unguarded stairway hole on the main floor.  Condition exposed employees to fall hazards of 10\\\'; and\\r\\n\\r\\n4)  Employees were working near 9 unguarded window openings on the second floor, with the window ledge ranging in height from 24\\\" to 36\\\", and from 24\\\" to 36\\\" wide, and the employees were not using fall protection.
