29 CFR 1904.7(b)(3): When an injury or illness involved one or more days away from work, the employer failed to correctly record the following workplace injury and/or illness correctly on the OSHA Log:     Located at Five Star Care Inc. dba Skyline Ridge Nursing and Rehabilitation: on or about August 16, 2011, the employer did not accurately record the following workplace injury and/or illness on the OSHA 300 Log for Calendar year 2009:    a) For an employee who experienced a right foot and ankle sprain on or about April 12, 2009 where the number of days away from work (Column H) was recorded as 89 days and the days of restriction (Column L) was recorded as 91.  The employer stopped the clock on counting days when the total of the two columns together reached the cap of 180 days.    b) For an employee who experienced a right wrist injury on or about April 17, 2009 where the number of days away from work (Column H) was recorded as 8 days and the days of restriction (Column L) was recorded as 172.  The employer stopped the clock on counting the days when the total the two columns together reached the cap of 180 days.

29 CFR 1904.29(b)(2): The employer must complete an OSHA 301 Incident Report form or an equivalent form, for each recordable injury or illness entered on the OSHA 300 Log:    Located at the Five Star Quality Care Inc dba Skyline Ridge Nursing & Rehabilitation Center; on or about August 15, 2011, an incident report (OSHA 301 or equivalent) for each injury or illness was not accurately completed as required by the regulation.    Calendar Year 2011:  All 5 of the entries recorded on the 300 Log, did not contain the information required in Block #12 on the employer's OSHA 301 or equivalent form for each of the 5 entries. Blocks #6 and #7 on the OSHA 301 or equivalent form were left blank for Entry #1, Entry #2 and Entry #4 of the OSHA 300 Log.  Block #6 on the OSHA 301 or equivalent form was left blank for Entry #5 of the OSHA 300 Log.  Block #7 on the OSHA 301 or equivalent form was left blank for Entry #3 of the OSHA 300 Log.    Calendar year 2010:  All 10 of the entries recorded on the 300 Log, did not contain the information required in Block #12 on the employer's OSHA 301 or equivalent form for each of the 10 entries.  Block #6 on the OSHA 301 or equivalent form was left blank for Entry #1, #2, #4, #5, #6 and Entry #7 of the OSHA 300 Log.  Blocks #4 and #6 on the OSHA 301 or equivalent form was left blank for Entry #3 of the OSHA 300 Log.  Blocks #6 and #7 on the OSHA 301 or equivalent form were left blank for Entry #8 and #9 of the OSHA 300 Log.     Calendar Year 2009:  All 5 of the entries recorded on the 300 Log, did not contain the information required in Block #12 on the employer's OSHA 301 or equivalent form for each of the 5 entries.  Blocks #6 and #7 on the Employer's 301 or equivalent form was left blank for Entry #1 of the OSHA 300 Log.  Block #6 on the OSHA 301 or equivalent form was left blank for Entry #3 on the OSHA 300 Log.    DEFINITIONS: An OSHA 301 or equivalent form includes blocks of information required to be recorded.  Block #6 is, "name of physician or other health care professional."  Block #7 is, "If treatment was given away from the worksite, where was it given?" Asking for facility name, street address (street, city, state and zip code).  Block #4 is, "Date hired." and Block #12 is, "Time employee began work am/pm."

29 CFR 1904.29(b)(3): Each Recordable injury or illness was not entered on the OSHA 300 Log and/or an incident report (OSHA 301 form or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness occurred:    a) On or about August 15, 2011 and at times prior, an injury occurring on February 14, 2011 was not recorded on the OSHA 300 for the Year 2011 within 7 calendar days of receiving information that a recordable injury had occurred.  The injury resulted in both days away from work and days of restricted activity.  Both Column K (number of days away from work) and Column L (number of days of restricted activity) were blank. Column K should have been recorded as 3 days and Column L should have been recorded as 60 days.    b) On or about August 15, 2011 and at times prior, an injury occurring on June 24, 2011 was not recorded on the OSHA 300 for the Year 2011 within 7 calendar days of receiving information that a recordable injury had occurred.  The injury resulted in both days away from work and days of restricted activity.  Both Column K (number of days away from work) and Column L (number of days of restricted activity) were blank. Column K should have been recorded as 23 days and Column L should have been recorded as 46 days.
