29 CFR 1926.502(b)(2): The employer did not install midrails between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches high:         (a) Global Work Resources LLC., 630 E. Hyman Ave., Aspen, CO 81611: On and before June 13, 2011 the employer did not install midrails at least 21 inches high on the guardrail systems accessing the elevator shaft. A employee fell approximately 27 feet by reaching his hands and body through the guardrail system where the midrail was measured at 19'' and the toprail measured at 42''.        (b) Global Work Resources LLC., 630 E. Hyman Ave., Aspen, CO 81611: On and before June 13, 2011 the employer did not install midrails at least 21 inches high on the guardrail systems around the mezzanine on level 2. It was reported that an employee fell approximately 27 feet by reaching his hands and body through the guardrail system on where the midrail was measured at 19'' and the toprail measured at 42''. 29 CFR 1926.501(c): The employer did not ensure that toe boards were installed in the guardrail systems to prevent objects from falling from higher levels: \r\n   (a) Global Work Resources LLC., 630 E. Hyman Ave., Aspen, CO 81611: On and before June 13, 2011 the employer did not ensure that toe boards were installed in the guardrail system around the mezzanine of level 2 to prevent objects from falling from higher levels onto employees.  Employee supplies and materials were found directly under the mezzanine making it possible that employees could be struck-by an object from above. \r\nAbatement Note: Abatement certification and documentation are required for this item (see enclosed \"Certification of Corrective Action Worksheet\").

There was no program available to allow employees to recognize the hazards of falling and employees were not trained in the procedures to be followed in order to minimize these hazards:\r\n \r\n   (a) Global Work Resources LLC., 630 E. Hyman Ave., Aspen, CO 81611: On and before June 13, 2011 the employer did not provide and implement a fall protection training program so that temporary employees could recognize potential fall hazards. Hyman Ave., Aspen, CO 81611: On and before June 13, 2011 the employer did not ensure that a competent person conducted frequent and regular safety inspections of the project site.  The guardrail system used for fall protection did not have the midrail installed at the correct height and was missing a toeboard. Hyman Ave., Aspen, CO 81611: On and before June 13, 2011 the employer did not ensure that the guardrail system on the roof edge was surfaced as to prevent injury to an employee from punctures or lacerations, and to prevent snagging of clothing. The wood used to erect the guardrail system was fractured and large bent nails were extruding from the wood attached to a support post.
