29 CFR 1926.451(b)(10): Scaffold components manufactured by different manufacturers were intermixed such that the components fit together with force and the scaffold's structural integrity was not maintained by the user:    (a) Best Priced Stucco at 459 North Ave. in Grand Junction, CO: On and before August 26, 2011 scaffold components of different manufacturers were intermixed such that the components fit together with force and the scaffold's integrity was not maintained.  A fabricated frame scaffold, two frames high, was erected to install stucco on a dental office building.  The second tier of the scaffold was comprised of non-standard posts instead of frames. On 8/30/11, the scaffold was comprised of components from at least three manufacturers.  This condition exposed employees to a fall hazard of approximately 16 feet.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    (a) Best Priced Stucco at 459 North Ave. in Grand Junction, CO: On and before August 26, 2011 the employer did not ensure the fabricated frame scaffold had been inspected for visible defects by a competent person before use.  Without the inspections employees were exposed to scaffold fall hazards of approximately 16 feet.    Abatement Note:  Concerning the requirements and duties of a competent person:    (1)  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    (2)  The competent person must be able to carry out the tasks specified in the standard. In order to be able to carry out the tasks the competent person needs to have knowledge in the issues relating to the strength and structural integrity of the scaffold. A competent person must be fully knowledgeable about erecting, disassembling, moving, operating,  repairing, maintaining and inspecting the scaffold.    (3)  Section 1926.454 states that a competent person will train employees involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold. To meet this requirement, a competent person must be fully knowledgeable about erecting, disassembling, moving, operating, repairing, maintaining and inspecting   the scaffold. 29 CFR 1926.451(g)(4)(i):  Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:    a) Best Priced Stucco at 459 North Ave. in Grand Junction, CO: On and before August 26, 2011, the employer did not ensure employees working on a scaffold were protected from falls via the use of guardrails along all open sides and ends of the scaffold. This condition exposed employees to fall hazards of approximately 16 feet.    Abatement Note: Crossbracing is acceptable in place of a midrail when the crossing point of two braces is between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The end points at each upright shall be no more than 48 inches (1.3 m) apart.
