29 CFR 1910.178(a)(4):     Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    Corbi Plastics, LLC, located at 2100 Cedar Street, Fremont, OH: On or about August 30, the employer failed to obtain manufacturer's approval to use a Rice Lake Weighting Systems front end attachment (Model 920i-2E, S/N 1483800037) with the Yale forklift (Model ERC050VGN36TE083, S/N A968N04223J). The forklift with the attachment was used to move products throughout the facility and to load/unload trucks/trailers. Employees were exposed to crushing, struck-by, caught in between, and tip over hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(4)(ii)(B):     Refresher training in relevant topics was not provided to the operator when the operator had been involved in an accident or near-miss incident:    A.	Corbi Plastics, LLC, located at 2100 Cedar Street, Fremont, OH: On or about July 28, 2011, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in the accident while driving Yale forklift (Model ERC060VGN36TE088, S/N A968N03494J), exposing employees to struck-by, caught in between, and tip over hazards.    B.	Corbi Plastics, LLC, located at 2100 Cedar Street, Fremont, OH: On or about July 29, 2011, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in the accident while driving Toyota forklift (Model 7FGCU25, S/N 67709), exposing employees to struck-by, caught in between, and tip over hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(o)(2):     Load(s) were being handled which exceeded the rated capacity of the industrial truck(s):    Corbi Plastics, LLC, located at 2100 Cedar Street, Fremont, OH: On or about August 30, the employer failed to ensure that Yale forklift (Model ERC050VGN36TE083, S/N A968N04223J), used to move products throughout the facility and to load/unload trucks/trailers, was used to handle loads not exceeding 4,850 lbs, the maximum rated safe capacity of the powered industrial vehicle. The PIV was used to handle loads such as, but not limited to, stacks of pallets with plastic sheets weighing up to 6240 lbs. Employees were exposed to crushing, struck-by, caught in between, and tip over hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
