29 CFR 1910.120(q)(1):  Employers who will evacuate their employees from the danger area when an emergency occurs, and who do not permit any of their employees to assist in handling the emergency did not provide an emergency action plan in accordance with 29 CFR 1910.38(a):    A) Tasty Breads International Inc. - The employer did not provide an emergency action plan for employees in accordance with the requirements of 29 CFR 1910.38(a), when an emergency occurs and employees are not permitted to assist in handling the emergency and must evacuate the facility. The emergency action plan must provide for employee safety from fire and other emergencies, including but not limited to an ammonia release.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with you certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records

29 CFR 1910.120(q)(2): The employer did not develop an emergency response plan for emergencies which shall address, as a minimum, the following areas to the extent that they are not addressed in any specific program required in this paragraph:1910.120(q)(2)(i) through 1910.120(q)(2)(xii):    A) Tasty Breads International Inc. - The employer did not develop an emergency response plan for emergencies which shall address, the following areas to the extent that they are not addressed in any specific program required in accordance with 29 CFR 1910.120(q)(2) that describes at least the following:    1.   Pre-emergency planning and coordination with outside parties.  2.   Personnel roles, lines of authority, training, and communication.  3.   Emergency recognition and prevention.  4.   Safe distances and places of refuge.  5.   Site security and control.  6.   Evacuation routes and procedures.  7.   Decontamination.  8.   Emergency medical treatment and first aid.  9.   Emergency alerting and response procedures.  10. Critique of response and follow-up.  11. PPE and emergency equipment.  12. Emergency response organizations may use the local emergency response plan or the state emergency response plan or both, as part of their emergency response plan to avoid duplication.     Employees were exposed to hazards from an anhydrous ammonia leak from the refrigeration system and the employer did not develop emergency response plan for emergencies for employees to used to ensure their safety during an emergency.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with you certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1):  Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a) Tasty Breads International Inc. -  The employer did not implement at the workplace a written hazard communication program in accordance with 29 CFR 1910.1200 that describes at least the following:    1) Requirement for labeling of containers or hazardous chemicals:  2) Material safety data sheet(s) availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards of non-routine tasks; and,  6) Methods to inform other employer(s) of material safety data sheets availability; the labeling system and any precautionary measures to protect employees.    The employees were exposed to a hazardous chemicals at the site, including, but not limited to, anhydrous ammonia, Bellacide 355 (contains - tributyl teradecyl phosphonium chloride) and Zep pH Perfect (contains nonylphenoxypoly (ethyleneoxy) ethanol).    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with you certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

The employer did not have a Material Safety Data Sheet (MSDS) available for the anhydrous ammonia that is used on site. (a) Tasty Breads International Inc. - The employer did not provide employee training which included the measures employees can take to protect themselves from the physical and health hazards of the chemicals in the work area including specific procedures the employer has implemented to protect employees form exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used in the event of an exposure to hazardous chemicals in the work place, including chemical releases, which includes but is not limited to anhydrous ammonia.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with you certification.
