29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:    On or about 8/31/11 during construction activities including but not limited to tuck pointing and weatherproofing from a two point swing stage scaffold approximately 55 feet high, the employer did not ensure employees working from an elevated platform were provided proper access to working levels. The employees were observed climbing into the scaffold from the roof by climbing on the guardrail system.

29 CFR 1926.452(p)(6):     Passage may be made from one platform to another only when the platforms are at the same height, are abutting, and walk-through stirrups specifically designed for this purpose are used:    On or about 8/31/11 during construction activities including but not limited to tuck pointing and weatherproofing from a two point swing stage scaffold approximately 55 feet high, , the employer did not ensure employees working from an elevated platform were provided proper access to working levels. The employees were using the scaffold to gain access to apartment balconies to perform work.

The personal fall arrest rope was wrapped around a stand pipe on the roof.

On or about 8/31/11 during construction activities including but not limited to tuck pointing and   weatherproofing from a two point swing stage scaffold approximately 55 feet high, the employer did not ensure employees accessing the scaffold from the roof were protected from fall hazards approximately 60 feet by a fall protection system/device.    b.	On or about 8/31/11 during construction activities including but not limited to tuck pointing and weatherproofing from a two point swing stage scaffold approximately 55 feet high, the employer did not ensure employees accessing and working from the apartment balconies from the scaffold were protected from fall hazards approximately 50 feet by a fall protection system/device.
