THE ORNAMENTAL STUCCO, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(b)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 309361343, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 2, 2007, WITH RESPECT TO A WORKPLACE LOCATED AT 96TH STREET AND 42ND AVENUE, PLEASANT PRAIRIE, WI 53148.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part: a. On or about August 29, 2011, at the above addressed jobsite, employees performing stucco operations from a tubular welded frame scaffold, thirteen (13) feet six (6) inches above the ground, were exposed to injuries from falls due to the lack of guardrails.
