29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    On or about 08/25/11 during the installation of a swing stage scaffold, the employer did not ensure employees used fall protection systems or devices when working from a roof top; thus exposing employees to a 15 to 17 foot fall.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:    On or about 08/25/11 during the installation of a swing stage scaffold, the employer did not ensure that when employees were working around skylights that they were covered or that fall protection was used by employees to prevent them  from falling through skylights.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.    On or about 08/25/11 during the installation of a swing stage scaffold, the employer did not ensure employees used and properly wore fall protection devices/systems correctly while using an aerial lift; thus exposing employees to a fall of approximately 24 feet.     AGILE SIGN & LIGHTING MAINTENANCE INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD CFR 1926.453(B) 2(V), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311445175, CITATION NUMBER 01, ITEM NUMBER 01 AND WAS AFFIRMED AS A FINAL ORDER ON 10/12/07, WITH RESPECT TO A WORKPLACE LOCATED AT 8465 MARKET ST. MENTOR, OHIO 44060.
