29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Jobsite: On September 2, 2011 employees performed sheathing activities on a five in twelve pitched roof wiith out a fall protection system in place. Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: a) Jobsite: On September 2, 2011 and times prior thereto, employees and the responsible person on site, did not acknowledge the fall hazards when performing framing activities that included sheathing, and take the appropriate actions to eliminate or minimize these hazards. Note 1) Effective September 16, 2011 conventional methods for fall protection, per 29 CFR 1926.501(b)(13) shall be used. The alternative methods for fall protection in residential construction as described in STD 03-00-001 will no longer be acceptable. Note 2) Abatement certification IS required for this item.
