Section (5)(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a moving vehicle when operating right side stand up drive garbage collection trucks:    1) On September 1, 2011, an employee was killed when he fell from a garbage collection vehicle while leaning outside of the cab from the right side stand up drive position.    Among other methods, some feasible and acceptable abatement methods are as follows:    a) Institute and enforce a work rule that complies with Colorado Revised Statute 42-4-237(2), which requires every driver of a motor vehicle to wear a fastened safety belt at all times while the motor vehicle is being operated on a street or highway.    b) Institute and enforce a work rule that complies with the instructions of the owners manual for the Condor side loading garbage collection vehicle which states to use the retractable seat belt when the vehicle is operated in the stand up position.    c) Institute and enforce a work rule that prohibits employees from leaning outside of an open cab of a moving vehicle while operating the vehicle from the right side stand up drive position.
