29 CFR 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference: On or about September 2, 2011, at the above addressed jobsite, employees were permitted to work in and near the traveled way of south bound Wood Street without providing signage indicating how motor vehicle traffic can move through the temporary traffic control zone as required by MUTCD Section 6G.03.

29 CFR 1926.652(g)(2): Additional requirement for shield systems used in trench excavations. Excavations of earth material to a level not greater than 2 feet (.61 m) below the bottom of a shield shall be permitted, but only if the shield is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the shield: a. On or about September 2, 2011, at the above addressed jobsite, employees were installing a sewer in a trench with approximately four (4) feet of earth material under the shield system. Employees were thereby exposed to the hazards associated with cave-ins.
