29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) The employees who moved paper mill product through out a warehouse and who loaded and unloaded shipping/recieving trucks utilizing propane power forklifts were not first trained by the employer in the safe operation of that equipment before employees began daily warehouse operation with forklifts.

29 CFR 1910.178(n)(4): Industrial truck driver(s) were not required to slow down and sound the horn at cross aisles and wherever vision was obstructed: On or about August 29, 2011, the employer had not implemented nor required forklift drivers to sound horn, slow down, and or stop before crossing intersection with obstructed views and a forklift operator traveling west bound through an obstructed plant floor intersection at area (A) toward the shipping/receiving area, did not sound horn, slow down, and or stop before crossing that intersection and struck an employee on a bicycle traveling across that intersection.
