29 CFR 1926.102(a)(1):     Employees shall be provided with eye and face protection equipment when machines or operationspresent potential eye or face injury from physical, chemical, or radiation agents.    a.    On the site where employees were using pneumatic nail guns to erect walls, the employer did not provide or ensure the employees wore the eye protection thereby exposing employees to a struck-by hazard.

29 CFR 1926.503(a)(1):     The employer shall provide a training program for each employee who might be exposed to fallhazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed inorder to minimize these hazards.    a.    On the Roberts Road job site where employees worked at heights greater than six feet, the employer did not provide fall protection training on how to recognize a fall hazard and determine the type of fall protection needed thereby exposing employees to a fall hazard.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.    On the Roberts Road job site where employees on Building 5 were installing sheeting and trim on the outside of the building, fall protection was not provided or enforced to be worn thereby exposing employees to a fall hazard.    b.    On the front of the building where employees were walking from a window to a ladder set up at the front of the building to gain access to the second floor, fall protection was not provided thereby exposing employees to a fall hazard.

29 CFR 1926.1053(b)(9):     The area around the top and bottom of ladders shall be kept clear.    a. On the side of the building exterior where employees were working installing window trim and roof sheeting, employees were using a second floor window as access to the roof.  The employees were observed and photographed using a metal extension ladder and climbing over a board to gain access to the second floor window, thereby exposing them to a fall hazard.
