29 CFR 1926.200(g)(2):     Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA.    On or about September 12, 2011 Hecker and Company Inc. did not comply with Section 6D.01 of the Manual on Uniform Traffic Control Devices, Millenium Edition when employees worked near the traveled way of York Road with its intersection of Lake Street and I-290 entrance ramp.  The employees worked within 4 feet of the traveled way that was not protected with temporary traffic barriers.  This exposed employees to commercial vehicle struck-by hazards that were fatal.      Abatement documentation is required in accordance with the requirements of 29 CFR 1903.19(d).

On September 13, 2011, Hecker and Company Inc. reported an employee fatality that had occurred on September 12, 2011, near the traveled ways of York Road at the intersection of Lake Street/I-290 ramp.  This accident was reported to the Aurora Area OSHA Office at approximately 09:15 hours September 13, 2011.    No abatement certification or documentation is required for this item.
